Why the State Applies Default Rules to Your Living Family
In law, dying without a formally documented will is known as dying "intestate." When this happens, the state presumes authority over your estate and uses its own rigid, statutory default rules to decide exactly where your assets go.
But what most people fail to realise is that this theory of intestacy also applies to you while you are still alive.
If you fail to create a clear plan for your family's upbringing, you create a vacuum. In the eyes of the law, failing to formalise your intentions is like being intestate—without a living will. When there is no will, the state's default rules apply, placing your family's future under the will of another.
As the ancient maxim of law states: "The one who has no will of their own, falls under the will of another".
The Trap of the Vacuum: Parens Patriae
The system we live in operates on universal default rules. It cannot manage millions of households individually, so it applies standard rules and interventions generically to everyone.
This mechanism is driven by a legal doctrine known as parens patriae (Parent of the Nation), which dictates that the Crown has a duty to act as the ultimate guardian for anyone who appears unable to care for themselves.
When an individual fails to express their will—when they fail to create their own defined values, culture, and lifestyle—they create a vacuum. This is where the state’s protective duty under the doctrine of parens patriae applies. It is in this vacuum that the state's 'default rules' are applied to take care of you.
If you do not choose your terms, the system assumes you are incompetent and chooses them for you.
How the Default Rules Control Your Life
When you do not use the recognised tools to define your life, the system’s standard operating procedures apply automatically:
In Healthcare: If you do not have a formally documented plan, standard medical advice will almost always be followed during a dispute, completely disregarding any unstated parental wishes. Without a Living Will or Lasting Power of Attorney, NHS staff and judges will apply state medical protocols regardless of your personal consent.
In Education: If there is no formal plan or financial provision—especially a trust—the default path is always mainstream state schooling. Home educating without a formal, written Philosophy or Home Education Trust makes it incredibly easy for the Local Authority or Family Court to step in and make decisions regarding the upbringing of your child.
In Family & Wealth: Without a clear record of a specific religious or ethical upbringing, a court will always default to a neutral, secular approach. Furthermore, if you accumulate assets without ring-fencing them inside a formal Private Trust, state and corporate rules take precedence over your legacy.
An unstated wish is legally viewed as merely an opinion. Without formal documentation, your desires hold no weight against the machinery of the state.
From Passive Compliance to Competent Sovereignty
True self-governance is not about hiding from the system or engaging in constant, exhausting battles with state agencies. It is about understanding that you secure your autonomy by proving your competence.
By consciously and actively creating the life you intend to live, you leave no vacuum for the state to fill. When you formalise your intentions using the tools the legal system recognises, you give the state no reason to intervene in its protective capacity because you are demonstrating that you are properly taking care of yourself.
